If you are serious about getting a patent, you should delete this thread.

But, in your original post you said you just got the idea.

Takes 1.5-2 years to get a patent.

1996 318ti NY 05-07-2009 08:38 PM

well then its filed is what i meant lol.

Gotcha.

Keep it quite for a couple years.

I filed for one a year and a half ago and I'm still waiting.

The problem is, just because you filed doesn't mean somebody can't run with it while you are still getting legally protected and organized.

I hope you make a billion $.:joy:

I am not a patent attorney and this is not legal advice.

However, from what I do know, a patent (once issued) is protected back to its original filing date.

Infringement during that time is also protected, entitling you to damages (money + injunction).

That doesn't mean that some enterprising individual can't obtain a patent on a similar invention that would obscure your own. But, there are a billion factors to take into account.

That sounds right, but somebody with a patent attorney ready to go can file quickly - the original thread poster may not be that far into it yet.

Did you do any searches to see if a patent for this idea already exists?

Or at least some serious googling?
