318ti S50 in San Francisco

For sale is my 1997 BMW318ti with S50 engine swap. 110k on the chassis, 130k on the cluster (also what it is registered at) 10k on the engine.

3.0l S50 Engine from early 95 M3
Bavarian Engine Exchange Stage II engine with less than 10k miles. (ported head, mild cams, ext)
Dyno'd at 246hp to the wheels.
5 Speed M3 trans - shifts perfectly
M3 front brakes, suspension, control arms, rack - everything
M Coupe rear diff 3.73's - Rebuilt with 70/30 lockup limited slip done by my buddies at diffsonline.com
M3 fuel system, radiator, front bumper, cluster, shifter, armrest (318tis didn't have armrests)
Heated Vader seats with normal wear.
Custom adapted Triflow exhaust.

Not cool. In California people are not allowed to buy this from you until you smog it. Or get a CARB sticker.

Not to mention, even if it did have smog in order it's still an illegal swap. In California, swapped engines must be from the same year or newer.

978 is a Boston number. Is this car a California car or a New England car. Could we get the chassis vin? Seller does state right in his craigslist ad that it is not OBD II compliant.

Nothing stops you from purchasing it. Plenty of places where it's legal.

Where in the states?
In january 2004, it was a federal mandate that said ODB2 cars must actually have a working ODB2 to check.

EPA link as to why this car wont pass legal smog in the US.

Since the car passes the tailpipe test, have you thought about adding sims?

The seller is being up front about the fact that, in its current state, it is NOT OBD-II compliant. A potential purchaser could make this a track car, swap the motor, ship it out of the country, etc., and would obviously be buying the car in as-is condition.

Ya, I made it pretty clear that it will not pass smog...hence THE ALL-CAPS approach. Total disclosure on this one. Look at the photobucket pictures, every bad part of the car is clearly depicted, close up, in 1080p HD.(my 3D camera got damaged by all of the pollution created by my car, that's why I'm forced to sell it) Not sure why you're getting offended that I'm selling a car that wont pass smog. Not trying to trick anyone.

News flash, NOT ALL STATES HAVE OBD2 SMOG INSPECTION. If you live in a place like this, you already know this.

Also, hot off the presses - YOU DON'T NEED TO REGISTER TRACK CARS IF YOU DON'T DRIVE THEM TO THE RACE! I do however recommend registering your trailer, its cheap.

The car was from mass, came here in 2005, but was not registered in CA until 2011. You wanna know how I got it smogged? I broke the law.

If you don't want to by my car, then don't. It's a $7000 S50 318ti with a $7000 motor.

Also, I am willing to ship the car...in case you don't want to get caught looking at an illegal car in San Francisco.

No need to bust the sellers balls on this one. He was forthcoming with all info and hasn't tried passing off a nightmare on others. Let him sell his car and he'll move on peacefully.
