Well, I purchased a set of E46 M3 headers from this guy in this auction. http://cgi.ebay.com/ebaymotors/ws/eB...190370243&rd=1 I paid for next Day shipping on the 21st, and I have still not received the headers. The guy was really good about returning emails for a couple of days, saying that he did not get them out because his girlfriend had a baby. However, he assured me that I would have them yesterday. Obviously I don't. So, I send him a couple more emails, only to have them ignored. I say ignored because he has been online. This is known by virtue of his leaving feedback for others at 9:30 last night. Oh, by the way, take a look at his items for sale on Ebay. http://stores.ebay.com/NEW-MUSIC-ALBUMS-SINCERE-TUNES They are all “digital items.” In short, you send a couple of bucks to his Paypal account and he sends you the album file. I wonder how well this comports with the RIAA, Ebay bylaws, and copyright laws in general. Am I to believe that he is a dealer in M3 headers or that he purchased one set without the mental wherewithal to realize that they would not fit on his 330? I am really not asking for much. All I want is either A) the headers that I paid for or B) payment to me for the cost of purchasing a new set—or as it's known, the “benefit of the bargain.” It's a funny thing about E46 M3's: They seem to be a car of choice for attorneys. Any help in solving this issue will be rewarded. It you lost that $37.00 over a header, then that deal sounds too good to be true anyway and you only have yourself to blame. Besides, the amount of consideration is not the measure of worth, rather it is the value of the thing bargained for. I am not new to Ebay. I have 100% feedback and a score of 88. If this sort of behavior is persistently tolerated then it will flourish and infest the cyber market--this cannot be allowed. If everyone just accepted these things when they occurred, then this would only breed more occurrences. It would be one thing if the auction ended for less than he anticipated and he sent my money back. Though this would be "wrong" I would appreciate the honesty. In this case, I suspect that he did not have the item in the first place, but he had the ad already typed up and figured it would be an easy way to steal a little money right before Christmas, while depriving an honest individual of that money to use for other uses. I am giving this guy the benefit of the doubt by allowing him to make good in one of the two aforementioned fashions. Did you pay with Paypal? Paypal has a $1000 fraud protection program so you should be able to report him and have the Paypal guys sick em. If I can find any other way to help Ill let you know. BTW, it might be a good policy not to buy cheapo ebay parts for high end cars, not only will that prevent you from becoming a victim again it will also ensure your car doesnt end up looking horrible.
