» Site Navigation | | » Recent Threads | | | | | | | | 09-19-2007, 12:48 AM | #1 | Junior Member Join Date: Feb 2007 Location: Utah Posts: 27 | She killed my Bimmer :( So I was driving home from school yesterday, and I came to a light, I entered the intersection to turn left on a green, it changed yellow and eventually red so I turn, some dumb lady runs the red at 40 mph and hits my TI, and bounces off hitting another car. She ran the red having babies in the car too. Needless to say, since we're in utah, the law states I get the ticket for failure to yield to oncoming traffic, even if the light is red. So now my TI is injured and in the repair shop. I find out if the insurance deems it totaled on thursday, but if it is its a 1996 318ti with 75000 miles active package and in excelent condition. How much do you think I will get if it is totalled? I have complete full coverage, and KBB.com says my car is worth 7,900 USD but will I get more than that? I wanna buy another TI if mine is gone. I hope she's not and I have a feeling she'll scrape by. The people say they can return her to factory specs if she isn't hurt so that will be nice! Do you think I'll be able to get some dough out if it if she doesn't make it? Honestly, I'd rather have my TI than money, but if she doesn't make it I wanna get a fair amount from it. If it is, my insurance will cover it completely. They said I'm liable due to the law so I can't make her pay. She admitted to running the light, and I hate utah too. Its a stupid city and the drivers are HORRIBLE!!!!!!! The idea is that you're clearing the intersection. I think it would suck for either of you to get a ticket after such an event occurred, would be like salt on a wound, but if she didn't get one you shouldn't either. I take that back now, some states do say that it is ok to make a left turn at a stop light controlled intersection if you were already in the intersection after the light turned red... The interesting thing is I was trying to look and see what the law is in Utah and I found a link from some Chief of Police that said you could do it, but make absolutely sure that the other traffic was really stopping. In Florida I think it depends. We have a bad redlight running problem, as most places probably do. I've seen cases where three or four cars were sneaking out into the intersection and the cops let the first car caught in the red to go, but pull over the cars behind the first driver. I'd say definitely fight that ticket. The person that ran the red light should have also gotten a ticket. I'd also think about either getting a lawyer or teaching yourself how to take up your case with the insurance as you were probably doing something legal, and the other person was not.
