Default Update on Sean

Sean accepted a plea bargain today for 5 years minimum with an 8 year cap. He had no choice. The DA was not willing to drop it any more than that. He'll be sentenced on Dec. 2. The cap means that the Judge can't go over the cap and if he does, Sean can withdraw the plea and go to trial. It also means he has to serve 75% of his sentence because this was considered a violent crime. I just wanted to let you guys know. If anyone is interested in sending support letters for him, I'll post my address for you on his profile. I know a lot of you have never met him and please always know that we have appreciated everything you have sent him as well as your thoughts and prayers.

Hopefully the hold on his car will be dropped soon. His boss is going to go and bid on it and get it back for him.

Wow.. I'm really sorry to hear that... Best of luck to you and him as you go through this ordeal.

I do have one question, and feel free not to answer if it is not something you want to discuss. Does he have a previous criminal record? It seems weird that the DA would press for such a harsh sentence for a first time offender.


To everyone else, this shows why it is best to turn the other cheek when dealing with stupid people. I know Sean probably felt like he was defending himself and his property, but you can see how horrible wrong it can go if you don't have anybody to back up your side of the story. So it is best to just walk away.

It's absolutely ridiculous that it turned out this way. Even though I never met Sean, I can tell that he is a stand up guy from the way that everyone supports him here.

I'm really sorry that you have to go through this. Hang in there.

That sucks Cindy, the way it he sounded on his letter i guess he knew this was coming. It sucks because there's bigger things going down like the shooting that happened a couple weeks ago like two blocks away where i live and they still haven't done nothing about that. Shows that justice is blind after all. This has been the dumbest thing i have heard, everyone is going to defend their property no matter what.

Thank you everyone. I'll print this out and send it to Sean. He was pretty upset today. The sentencing date is wrong it's actually Nov. 7th. The judge can still double the max (16 years), but if he does then Sean can withdraw his plea and go to trial as if a guilty on that would be better.

Yes Sean was on parole for criminal mischief in a case that had something to do with an ex-gf. It just goes to show that once you're in the system it never lets you go.

I saw an interesting bumper sticker today, it said "An eye for an eye makes us all blind." At first I thought it was really appropriate in Sean's case, but then I went to court and realized that the "justice" system is no better than he is. It's all about punishment and retribution.

There were 3 people involved in this, 2 against 1. One of the 2 was hurt, but both of them made the choice to follow Sean 11 blocks and attack him. Had he not been on parole things may have been different and maybe they would have been facing jail time. I don't know. All 3 of them were wrong, and each of them are equally responsible for what happened, but the only people who are really going to be punished for it is me and our kids and grandkids.

I'm sad tonight.

It's things like this that make me really doubt the Justice system in this country. I really can't believe it, it just sounds absurd. Hang in there, and you both are in my prayers.

If you guys haven't seen it, there's a new show on TNT on Monday nights called "Raising the Bar". It's based on the experiences of a former public defender. I think the show is dead on about how the "justice" system really works. I'm sure you can also find the shows to watch online. It's an excellent show and a sad commentary on how our country really is when it comes to the law.
