Hmm, that's interesting. I wasn't sure if Ohio laws were similar to other states at all so I thought I would throw that in there. Apparently they are different.

Did you have it insured as a Club Sport or as a base? If you enrolled it as a base then chances are that is all that's covered. When you enroll with your insurance they also ask does your car have any extra equipment, in case you want to insure that too. If it was insured as a clubsport, or if the "extras" were covered then they can't deny payment. But if the "extras were not insured then I think you're screwed. I hate to say it but your best option is to probably get the car back from them with the salvage title and pocket the $1400. If it's as cheap to fix the car as you said then you can get it fixed, just with a salvage title. If you plan on keeping it for a while - no biggie. At least you know what was damaged and fixed. You might also be able to do some work yourself and save some $$$. I do feel your pain. Your situation sucks.

Just wondering, wouldn't this be evidenced with the VIN?

FWIW, if you're a BMWCCA member, your local chapter MIGHT help you substantiate your car's value.

Here's what we have listed for the Boston chapter:

Car Evaluation
Our Value Information Coordinator helps members establish proof of true market value on specific BMW models for insurance or resale purposes.

Regards,
Sergey.

sorry to hear of the loss man. as for talking some reason into those bastards...id say find out exactly what u need for parts, get some really good detailed pictures of the damage and go to every body shop within 50 miles in some hope that you will find someone that will give you a good quote.

my 95 sport was a hit and run victim. the insurance adjuster didnt even beleive it was worth more than the $3200 repair bill... after i just bought the car 2 weeks before that for $5000. good luck man.
